Notary house transaction: what you sign and how to protect yourself

Signing a contract at the notary

A notary is not just a «witness» but the link that verifies documents, ownership, the payment flow and the Cadastre handover. In 2026 the appointment takes 90 minutes but the details must be understood beforehand.

1. Documents for the appointment

From the seller: fresh registry extract (e-mulk.gov.az), ID, marital status (spouse consent if married), tax certificate. From the buyer: ID and payment confirmation (bank or escrow). The notary is connected to e-notariat in real time.

2. Deal flow — 90 minutes

Standard flow: 0-15 min — document check; 15-45 — main contract clauses; 45-70 — payment (transfer or escrow); 70-90 — signatures and Cadastre submission. Buyer appears as owner in the registry in 2-4 working days.

3. Six must-have clauses in the contract

Read carefully: 1) «object» — correct cadastre number; 2) «price» — full amount and currency; 3) «payment» — account, date; 4) «condition» — what's included (furniture, pool equipment); 5) «encumbrances» — seller confirms none; 6) «liability» for hidden defects.

4. Safe payment — 3 options

Cash — never. Three real options: 1) bank transfer to the seller's account in the notary's presence, with deal reference; 2) escrow — safest, 0.3-0.7% fee; 3) letter of credit — funds release on bank confirmation. For a remote buyer, escrow is mandatory.

5. Fees and commissions

2026 numbers: state fee0.3% of price; notary commission — 200-450 AZN; Cadastre registration — 40-90 AZN; translation (foreign buyer) — 60-140 AZN. For a 600,000 AZN house — 2,100-2,700 AZN total.
